1. Agreement to Terms

By accessing or using predictexam.ai ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service. By using the Service, you represent that you are at least 13 years old (or 16 in the EU/UK) and have the legal capacity to enter into these Terms.

2. Description of Service

predictexam.ai is an AI-powered exam preparation platform that:

  • Generates practice exams from user-uploaded study materials
  • Provides AI-powered grading and feedback
  • Creates spaced repetition flashcards for learning reinforcement
  • Offers analytics and insights on exam performance

3. User Accounts

3.1 Account Creation

You must create an account to use most features of our Service. You agree to provide accurate, current, and complete information during registration and to update such information as needed.

3.2 Account Security

You are responsible for safeguarding your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

3.3 Account Termination

You may delete your account at any time through the Settings page. We may suspend or terminate your account if you violate these Terms or engage in conduct that we determine is harmful to other users or our Service.

4. Subscriptions and Payments

4.1 Free and Pro Plans

We offer a free tier with limited features and paid Pro subscriptions with enhanced capabilities. Subscription details and pricing are available on our pricing page.

4.2 Billing

Pro subscriptions are billed in advance on a monthly or annual basis. All payments are processed securely through Stripe. You agree to pay all fees associated with your subscription.

4.3 Cancellation and Refunds

You may cancel your subscription at any time through the Settings page or Stripe customer portal. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial subscription periods, except where required by law.

4.4 Price Changes

We reserve the right to modify subscription prices. We will provide at least 30 days' notice before any price increase takes effect for existing subscribers.

5. User Content

5.1 Your Content

You retain ownership of all content you upload to the Service ("User Content"), including study materials, documents, and images. By uploading content, you grant us a limited license to process your content solely for the purpose of providing the Service.

5.2 Content Restrictions

You agree not to upload content that:

  • Infringes on intellectual property rights of others
  • Contains malware, viruses, or harmful code
  • Is illegal, defamatory, obscene, or offensive
  • Violates the privacy rights of others
  • Contains copyrighted exam content without authorization

5.3 Content Removal

We reserve the right to remove any User Content that violates these Terms or that we determine, in our sole discretion, is otherwise objectionable.

6. AI-Generated Content

Our Service uses artificial intelligence to generate exam questions, answers, and feedback. While we strive for accuracy, you acknowledge that:

  • AI-generated content may contain errors or inaccuracies
  • The Service is for educational practice purposes only
  • AI-generated exams should not be used as the sole study resource
  • We do not guarantee exam results or academic outcomes

6.1 Understanding "Prediction"

The term "predict" as used in our service name, branding, and marketing refers to AI-based probability analysis of likely test topics based on your uploaded study materials. It does NOT mean we guarantee, promise, or warrant that any specific questions will appear on your actual exam.

Actual exam content is determined solely by your educational institution, instructor, or testing organization. Our AI analyzes patterns in your study materials to generate practice questions on topics that are statistically likely to be important—this is an educational tool to help you prepare, not a prediction of actual exam questions.

6.2 AI Transparency

In compliance with applicable AI transparency laws, we disclose that:

  • All exam questions on this platform are generated by artificial intelligence (Google Gemini)
  • All grading, feedback, and study insights are AI-generated
  • Flashcards and recommendations are created by AI based on your exam performance
  • You are interacting with an AI-powered system, not human tutors or educators

7. Intellectual Property

7.1 Our Property

The Service, including its original content, features, and functionality (excluding User Content), is owned by predictexam.ai and protected by copyright, trademark, and other intellectual property laws.

7.2 License to Use

We grant you a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial educational purposes in accordance with these Terms.

8. Prohibited Uses

You agree not to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Attempt to gain unauthorized access to our systems or other user accounts
  • Interfere with or disrupt the Service or servers
  • Reverse engineer, decompile, or attempt to extract source code
  • Use automated systems (bots, scrapers) to access the Service
  • Resell, redistribute, or commercially exploit the Service
  • Use the Service to generate content for commercial exam preparation products
  • Circumvent any usage limits or access controls

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that: (a) the Service will be uninterrupted or error-free; (b) defects will be corrected; (c) the Service is free of viruses or harmful components; or (d) the results obtained from using the Service will be accurate or reliable.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL PREDICTEXAM.AI, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability for any claims arising from or related to these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless predictexam.ai and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your User Content; or (d) your violation of any rights of another.

12. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

For users in the EU/EEA/UK, nothing in these Terms affects your statutory rights under applicable consumer protection laws, and you may bring proceedings in your local courts.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
